You also release any moral rights to the content to the greatest extent permitted by law. We retain the right to delete content if we detect a violation of these terms or the rights of any party.

In most cases, using the Services is free. We may charge a fee for specific features or Services on occasion. If the function you use has a fee, you can evaluate and approve it before purchasing it. Any features you have added to your ad will not be halted if you choose to pause it at any time. Our fees are given in Australian dollars and are subject to change. We will inform you if there's any change to our fees by posting them on the website. UmmaUp will confirm your enrollment in our program and email you instructions on how to submit subsequent reports electronically after we receive your first NOCI. We can share the completed NOCI form with the third party that initially placed the allegedly infringing listing in line with relevant legislation.

Services are offered on an "as is" and "as available" basis. You agree not to hold us liable for anything that other users post or do. Because different users contribute the majority of the information on the Services, we cannot guarantee the accuracy of postings or user communications nor the quality, safety, or legality of what is provided. Without limiting the above, you acknowledge and agree that any seller listing that uses the 'Price Drop' function was done at the exclusive discretion of that individual user for their listing. UmmaUp disclaims any liability to you for any loss or damage you experience as a result of UmmaUp failing to conform with an applicable statutory guarantee under the Australian Consumer Law if the loss or damage was not reasonably foreseeable was not caused directly by UmmaUp.

You agree to indemnify and hold harmless UmmaUp and our affiliates, as well as our and their respective directors, officers, employees, and agents, (each an "Indemnified Party"), from any claim, that any third party makes, including any amounts that is payable to the third party, whether in settlement or as otherwise awarded and reasonable legal costs obtained by any of the Indemnified Parties, relating to or arising from to your use of the Services, any supposed violation by you. This Policy is intended to help you learn more about these technologies and how we use them on our websites and in our services, applications, and tools. The following is an overview of some essential points concerning using such technology.

Our cookies and related technologies serve many purposes. They are required to operate our services, assist us in improving our performance, provide you with additional functionality, or allow us to offer you relevant and targeted advertisements. We use cookies and the same technologies that only stay on your device for as long as you have your browser open (session), as well as cookies and similar technologies that remain on your device for longer (persistent). If your device allows it, you can block, remove, or disable these technologies. You can manage cookie choices in your browser or device settings.

Security precautions are put in place whenever feasible to stop unauthorized access to our cookies and similar technology. A unique identifier guarantees that cookie data is only accessible to our approved service providers and us.

Service providers are businesses that assist us with different areas of our operations, such as site operations, services, apps, ads, and tools. We work with select approved service providers to offer you relevant adverts on our services and elsewhere on the internet. These service providers may also store cookies on your device because of using our services (third-party cookies). They may also collect information that aids in the identification of your device, such as your IP address or other unique device identifiers.

What exactly are cookies, web beacons, and related technologies?

We use technologies, which are essentially small data files placed on your mobile phone, tablet, computer, or other devices (named collectively as a "device") that let us record specific pieces of information whenever you interact or visit our sites, services, applications, messaging, and tools, as do most other places.

The names and kinds of cookies, web beacons, unique identifiers, and similar technologies that we use to gather information (e.g., about the pages you visit, links you click, and other activities you do on our Services, within our advertising or in email content) may vary from time to time. We have created a video to assist you in better understanding our Policy and our usage of such technology.

  • Cookies are small text files (usually made up of letters and numbers) that are stored in the memory of your device or browser or when you visit a website or read an email. Cookies enable a website to recognize a particular device or browser. Cookies are classified into numerous types:
  • At the end of your browser session, session cookies expire and let us associate your activities during that session.
  • Persistent cookies are retained on your device between browser sessions, letting us remember your preferences or actions across various sites.
  • The site you are visiting sets first-party cookies.
  • Third-party cookies are placed by a site other than what you are now viewing.
  • Cookies can be blocked or erased using options included in most commercial browsers. You must adjust each browser's settings independently, and various browsers provide varied capabilities and options.
  • Web beacons - Small visual images (also known as "pixel tags" or "clear GIFs") that you may put on our sites, services, applications, messages, and tools to identify our users and user behaviour.
  • Similar technologies - Technologies that use local shared objects or local storage to store information in your browser or device, such as flash cookies, HTML 5 cookies, and some other web application software approaches. These technologies can run across all of your browsers, but they may only be partially handled by your browser and may require maintenance directly through your installed programmes or device in some cases. We do not use these technologies to store information about you to target advertising to you on or off our websites.

On our policies, we may use the terms "cookies" or "similar technologies" interchangeably to refer to all technologies we employ to store data in your browser or device, collect information, or assist us in identifying you in the specified way above.
